Grell On RICO

In 1970, Congress passed the Racketeer Influenced and Corrupt Organizations (RICO) Act, Title 18, United States Code, Sections 1961-1968. At the time, Congress' goal was to eliminate the ill-affects of organized crime on the nation's economy. Throughout the 1970's, RICO was seldom used outside of the context of the Mafia. In the 1980's, however, civil lawyers noticed section 1964(c) of the RICO Act, which allows victims of racketeering to bring civil claims and recover three times their actual damages. The financial windfall available under RICO inspired the creativity of lawyers across the nation, and by the late 1980's, RICO was a (if not the most) commonly asserted claim in federal court. RICO's broad application was the result of Congress' inclusion of mail and wire fraud as two crimes upon which a RICO claim can be brought. During the 1990's, the federal courts, guided by the United States Supreme Court, engaged in a concerted effort to limit the scope of RICO in the civil context. As a result of this effort, RICO has become one of the most complicated and unpredictable areas of the law. Today, RICO is almost never applied to the Mafia. Instead, it is applied to individuals, businesses, political protest groups, and terrorist organizations. The purpose of Grell on RICO is to simplify this very complicated area of the law and to articulate and make more predictable the legal standards that govern such claims.

Grell on RICO is an outstanding book for someone trying to understand RICO. Once a person gets through the book, he will understand RICO and the logic and intended application of the RICO statutes. While I agree that I would like to see an update to Grell on RICO, the law has not that substantively changed. Beyond this, one has to face the varying interpretations by each of the areas of the courts of appeal, and then differing requirements of the various federal district courts within those courts of appeal areas.This book is simply the best available in comprehending the intent, the logic, and application, of the RICO statutes. It also interesting to read, and written with a sense of humor. You will not find better for this purpose. Even an “up-to-date” publication will be difficult to locate with the legal publishers, such as Lexis or West Law, or the American Bar Association. If you can find such a version (does not exist), the version will be much more expensive and will not teach you the RICO principles as well as Grell on RICO does.

I found "Grell on RICO" in preparing my RICO complaint against the Washington State Bar-- their "disciplinary" board, which is nothing but a protection racket where lawyers use the courts to commit crimes against individuals. As expected, District Court Judge, Ronald B. Leighton, a Washington State Bar Associate, dismissed w/prejudice the case against those of the Washington State Bar (who operate as associates in fact) ... it is on appeal as the dismissal is a violation of 28 USC 455 (disqualification due to bias and conflict -- all Bar Associates in WA are bound by statutes and thus share a fiduciary duty with one another that is owed to citizens)It is a good book... I'm hoping my case will supplement its content.
